Terms and Conditions of E-Banking Services
The following words and expressions wherever they appear, shall have the meanings assigned to them unless the context indicates otherwise.
1- Bank: Jordan Kuwait Bank
2- Customer: Account(s) holder whose subscription in electronic services has been accepted who shall be fully responsible for the usage thereof and who shall benefit from the services provided through it.
3- Business Day: The official office hours of the Bank during which it deals with customers being from 8:30 am until 3:00 pm or as may be determined from time to time by the Central Bank.
4- Electronic Services: Services which are provided by the Bank comprising Online Banking, Phone Banking, Push Notifications and any electronic service(s) that the Bank decides to provide in the future; hereinafter referred to as the "Service".
5- Transactions: Banking service(s) that the Bank agrees to provide to the customer through electronic services.
6- Customer's Account: Accounts which the customer maintains with the Bank related to the usage of electronic services.
7- Pin Code: Identification Code which the Bank issues to the customer.
8- Electronic Transfer Order: Any electronic transfer order and/or information and/or instructions related thereto.
9- Notification: Information message issued by the Bank which is forwarded to the customer by one of the electronically available means and/or as the Bank deems appropriate.

General Conditions:
1) By signing this application, I discharge you from any liabilities or damages which may be sustained by me or by any person whomsoever due to my non-compliance with the terms, conditions and instructions issued by you or due to the misuse of the service by me or by third parties of whatever capacity and I undertake to indemnify you for any damages whether monetary or moral relating to your reputation.
2) I understand that if you agree to my participation in the service(s) referred to above, you shall provide me or provide my authorized signatory with an envelope containing my Pin Code for such Service and I acknowledge that receipt of the envelope shall be deemed an acknowledgment by me that it is properly sealed and I waive my right in challenging or claiming otherwise in the future. I also understand that I can do self-registration and/or forgot password services using my ATM card number and its PIN which will be considered as identification means determining my identity with you, and any operations performed using these means considered issued by me, and I waive my right in challenging or claiming otherwise in the future
3) I undertake to immediately notify you about possible third party access to my account or the probability of third parties knowing my Pin Code and I shall be obliged and undertake to be responsible for all transactions and amounts which have been transferred as a result thereof until the end of the working hours on the day in which you are so notified in writing by me and I further authorize you unconditionally and irrevocably to take any measures that you deem appropriate including the cessation and/or non-execution of the Service or transactions without any liability or responsibility on your part .
4) I have understood your instructions in respect of changing the Pin Code upon using the Service for the first time within the services so requiring and prior to executing the transaction and I am fully responsible for keeping and safeguarding the Pin Code and fully understand that the Pin Code determines my identity with you. I undertake and shall be obliged not to make it known or pass to third parties and undertake to take the necessary precautions in the event of using the Service in any public place.
5) I shall be absolutely committed to restrict the usage of the Pin Code given to me solely to myself personally and I am committed for not permitting any other party to use it under any circumstances or for any reason whatsoever and I agree that all transactions that took place or shall take place through the Pin Code are authorized by me personally and shall be considered binding and a conclusive evidence against me the same as of the Bank's books and records. I am committed not to challenge same or even object thereto or assert the non-issuance thereof, whereby I discharge you of liability for any executed transaction through any of the above services regardless of its type, cause or origin.
6) I understand that any of the services shall be temporarily suspended upon entering the wrong Pin Code for the determined number of times by the Bank and I shall comply, if I wish to activate or revitalize the Service, to coordinate and/or follow-up with the concerned Branch.
7) I acknowledge that I am solely responsible for maintaining the confidentiality of all the information related to my account(s) with you or of the payment instructions and financial transfers and any other information which may be accessed, conveyed and stored from any automatic account or other similar electronic device and I confirm that in the event of using the Internet to access the electronic banking services, I shall be fully and solely responsible for any acts arising from the usage and/or the unauthorized usage thereof and/or misuse by any party whatsoever that would result into direct or indirect losses or damages to me or to the Bank.
8) I agree that you shall not be liable for any financial loss that I may sustain due to entering wrong account numbers of beneficiaries or due to transferring any amount from my account to the account of another customer by mistake via such Service within the services that permit transfers to a third party and I shall be solely held liable for the consequences of such mistakes and release the Bank from any liability that may result in that respect.
9) I understand that despite your utilization of all possible protection means, you shall not be liable for any damage that I may sustain due to the exposure of the public telecommunications network of the Internet Network and/or any other entities that practice such activities due to a force majeure beyond your control and whatever risks resulting therefrom and I shall solely bear all such risks that may result from such cases.
10) I understand that you shall have the right , at your sole discretion without giving reasons, to cease dealing in such Service and/or to withhold it from me for a temporary period or to cancel it for any reason without prior notice.
11) I undertake to follow the instructions and guidelines provided to me by you which contain detailed information about the Service and the method of operation thereof without you bearing any liability in the event of any irregularity or interruption of the Service or the existence of a technical error in the information obtained through it.
12) I authorize you to rectify the errors that occur in the electronic transfers of funds deeming my signature on this Application as an irrevocable peremptory authorization to you if such errors relate to reversing an amount or part thereof that has been credited or debited to my account.
13) I shall be fully responsible for the provision, safety and maintenance of my devices and everything required for the operation thereof including inter alia the telecommunication expenses, costs and fees and I fully understand that you shall have no liability that would result from any defect in the software used by me or in the event of using other devices or additional software that would expose the security and efficiency of the Service to danger or any viruses on my personal computer which would expose my significant data and I undertake to solely bear all consequences resulting therefrom.
14) I understand that you have the right to amend, alter or modify any of the terms and conditions of the subscription membership in the Service anytime you desire without prior notice to me. Moreover, you shall also have the right to add a new service or change the software utilized in the provided Service and I shall be deemed to have accepted same in the event of the usage thereof.
15) I understand that you are entitled, at any time you desire, to collect/increase any fees, commissions, expenses, other charges or all of the foregoing as a consideration for providing the Service by debiting any of my accounts with you, provided that I shall be so notified within a maximum period of 14 days by the means that the Bank deems appropriate.
16) I understand that the Bank has the absolute freedom to renew/amend/cancel the determined limits by the Bank in respect of the transfer transactions executed in terms of number and/or value through any of such services (which are currently specified at JD5000 and/or a maximum total number of entries of 100 per day for the service) whether concerning the same accounts or third party accounts, provided that I shall be notified within 14 days of such amendment by the means that you deem appropriate unless the amendment is of a temporary nature and is considered necessary for the security and safety of my account(s) with you and/or for the security and safety of the electronic transfer.
17) I understand that all transfers/payments are performed automatically and are debited on my account on the same date of executing the transaction if it were an official working day or on the next official working day if it were a holiday. I understand that I cannot cancel the transfer/payment order via the Service after confirming (executing) the transaction and that you are not obliged to issue any Notifications about the executed transactions as such transactions are deemed to have taken place with my prior consent.
18) All transactions which are performed through the electronic services shall be considered a written authorization by me to you in that regard.
19) In the event of requesting a cheque book and/or credit card via the Service and in the event of your approval, I undertake to follow-up with the concerned Branch to initially receive the cheque book as per the bank’s procedures and/or to complete the procedures for requesting the card. I agree in advance for debiting my account with you with the fees that you determine and waive my right in advance to challenge or object to any entry or action that you carry out in that regard.
20) I undertake to provide you with a written notice signed by me in the event that I wish to cease any standing order related to my instructions within the standing orders entered through the Service.
21) I agree that you shall not have any liability due to my payment of any invoices, transactions, receipts or transfers through such services and for my faulty entry of any figures or data related thereto without the need to issue any Notifications in respect of the executed transactions.
22) In the event that I am a co-holder of an account, I undertake to provide you, upon my signature of this Application and prior to activating the Service and/or services by virtue thereof, with a written approval of all remaining co-holders who shall be committed by virtue thereof on account of being liable jointly and severally for all transactions that shall be carried out pursuant to this Application.
23) If I find out that you have not executed any transaction for any reason whatsoever, I agree that you shall not bear any loss that might arise due to the non-execution of the transaction for any reason and I waive my right in any claim regardless of its type, cause or origin.
24) The Bank shall be entitled to cancel my subscription to the Service in the event that it is being notified of a provisional or an executive attachment against me or upon being notified of a judgement against me regarding liquidation, declaration of bankruptcy, cessation or default of payment.
25) I agree to the application of the provisions of the electronic transactions Law and to any instructions issued or may be issued in pursuance thereof in respect of this Application and to comply therewith and agree with all instructions that the Bank may issue from time to time which are related to the electronic services and/or which regulate the conditions of accounts with you.
26) I acknowledge that I do not have any intellectual property rights in any of the programmes, screens or documents provided to me by you and/or which you update and/or modify. I shall neither copy or modify nor permit third parties to copy or modify such programmes, screens or documents provided by you or upload or transfer the electronic --banking services programs from any computer, phone or other similar device.
27) By subscribing to the e-Statement Service, I unconditionally and irrevocably authorize the Bank to send the frequent e-Statement by e-mail and to send the password of the e-Statement by SMS to the mobile phone number stated in the Application and I also acknowledge that I have taken the necessary precautions to safeguard the confidentiality of the received messages and shall bear any liability resulting therefrom.
28) In the event that I wish to stop the e-Statement Service, I undertake to provide you with a written notice signed by me.
29) I authorize the Bank to automatically enroll me in the SMS service through the mobile phone service (which shall take place in an acceptable manner for the Bank) unless written instructions to the contrary are given by me upon signing this Contract and I release the Bank from any liability or indemnity resulting therefrom.
